Applying for a 482 Visa: What Sponsorship Seekers Need to Know

Applying for a 482 Visa (a work and skill visa for Australia): What Sponsorship Seekers Need to Know

So, you’ve seen the Australian skills list or you’ve been offered a job in Australia! Or perhaps you are just starting your journey (check out the current skilled operation lists here)

In any case, this blog covers some basic information you’ll need to know.

Here is what visa holders should focus on:

Meeting Skill and Qualification Requirements

To qualify for a 482 Visa, it’s crucial to meet the following thresholds:

  1. Threshold 1: At least 1 year of relevant, full-time work experience in the position.
  2. Threshold 2: Relevant formal qualifications or equivalent work experience.

For example, a Bachelor’s degree can often be substituted with 5 years of full-time relevant experience. Similarly, trade certificates or Diplomas can be replaced with 3 years of experience. It’s essential to align with the Department of Home Affairs’ occupation standards, as outlined in the ANZSCO (Australian and New Zealand Standard Classification of Occupations). The ANZSCO specifies qualifications, tasks, and duties required for each eligible occupation.

Ensure that qualifications or experience align with the role to avoid hurdles during the application process.

Labour Market Testing (LMT)

Labour Market Testing is a mandatory requirement for sponsorship. This involves proving that the Australian job market doesn’t have suitable local candidates to fill the role. Key aspects include:

  • Posting job ads on two nationally recognized job sites for 28 consecutive days.
  • Including comprehensive job details in the ads, such as title, description, qualifications, salary (if below AUD $96,400), location, and employer name.

Be vigilant about meeting all LMT requirements. Any mistakes, such as failing to keep ads up for the full duration, can lead to application rejection, costing valuable time.

Salary Requirements

Sponsorship requires adherence to strict salary guidelines. There are three key considerations:

  1. Salary Thresholds: Meet the Core Skills ($73,150) or Specialist Skills ($135,000) thresholds.
  2. Modern Award Rates: If the position is governed by an Award, the salary must match the higher rate (if applicable).
  3. Australian Market Salary Rate (AMSR): Ensure the proposed salary aligns with market standards to avoid scrutiny or application refusal.

Meeting the highest of these standards is critical for successful sponsorship.

By understanding and addressing these factors—skills, labour market testing, and salary—visa applicants can better navigate the sponsorship process. Proper preparation ensures a smoother pathway toward securing a 482 Visa.
